GG Live CLE Video Webinar Series | Willful Infringement and Enhanced Damages: Litigation Takeaways in an Evolving Landscape

Webinar date and time: Wednesday, August 24, 1:00PM – 2:00PM ET.

On Wednesday, August 24, 2022, please join Cook Alciati and Michael Dorfman for “Willful Infringement and Enhanced Damages: Litigation Takeaways in an Evolving Landscape.”

Parties often wonder what is required to form the basis for an allegation of willful infringement, including whether and to what extent pre-filing communications are required.  The Federal Circuit has offered some guidance, but district courts take different approaches.  Further, there is an interrelationship between a finding of willfulness and an exceptional case, but not a requirement.  Still further, even upon a finding of an exceptional case, the award of enhanced damages has varied significantly from court to court.  In the end, the landscape has evolved and continues to evolve, requiring patent practitioners and corporations to pivot to meet these changes.

Gardella Grace Obtains Verdict of more than $38 million in Favor of Client

Gardella Grace P.A., led by Principal Cook Alciati, obtained a verdict of more than $38 million (plus an amount of prejudgment interest to be determined) in favor of its client Steuben Foods, Inc. following a week-long jury trial before Chief Judge Colm F. Connolly in the United States District Court for the District of Delaware.  The jury found all six asserted claims infringed and not invalid and awarded the full amount of damages requested.  The verdict comes after 10 years of litigation and post-grant proceedings wherein Greg Gardella worked with Mr. Alciati to defend the validity of the patents-in-suit in both reexamination and inter parties review proceedings.  Like all verdicts, this is subject to post-trial motions and appeal.

The verdict form can be found here.

GG Live CLE Video Webinar Series | In Possession of an Invention? Litigation Insights for Life Sciences Patent Drafting

Webinar date and time:  Tuesday, March 15, 2022, 1:00-2:00 pm EDT.

This webinar will review recent Federal Circuit decisions addressing the written description requirement of 35 U.S.C. § 112 in the context of inventions directed to the life sciences field.  Since the Federal Circuit affirmed that the written description requirement is different than the enablement requirement in its en banc decision in Ariad Pharmaceuticals, Inc. v. Eli Lilly & Co., 598 F.3d 1336 (Fed. Cir. 2010), a lack of written description defense has been a useful tool for patent challengers even where the specification may otherwise enable an invention.

On Tuesday, March 15, please join patent prosecutor Dr. Patrick Halloran and litigators Cook Alciati and Michael Dorfman for “In Possession of an Invention?  Litigation Insights for Life Sciences Patent Drafting.”  They will provide an analysis of recent Federal Circuit decisions addressing the written description requirement in the life sciences field with an eye toward what the patent prosecutor can learn from contested proceedings addressing the written description requirement.  The webinar will focus on the common question of whether the specification discloses sufficient species to offer written description support for a claimed genus and how to best assess that as part of claim drafting to avoid litigation surprises.  They will cover:

I.                 Recent Federal Circuit case law

II.                What these Federal Circuit decisions tell us about the importance of the written description requirement in litigation

III.              How patent prosecutors can anticipate and mitigate the risk of a written description challenge in future contested proceedings

This webinar will provide useful insights for specification and claim drafting that will pay dividends in the event future litigation is required.

Continuing Legal Education Credit (CLE) is available. Gardella Grace will apply for CLE credit where requested.
