This webinar will review recent Federal Circuit decisions addressing the written description requirement of 35 U.S.C. § 112 in the context of inventions directed to the life sciences field.  Since the Federal Circuit affirmed that the written description requirement is different than the enablement requirement in its en banc decision in Ariad Pharmaceuticals, Inc. v. Eli Lilly & Co., 598 F.3d 1336 (Fed. Cir. 2010), a lack of written description defense has been a useful tool for patent challengers even where the specification may otherwise enable an invention.


On Tuesday, March 15, please join patent prosecutor Dr. Patrick Halloran and litigators Cook Alciati and Michael Dorfman for “In Possession of an Invention?  Litigation Insights for Life Sciences Patent Drafting.”  They will provide an analysis of recent Federal Circuit decisions addressing the written description requirement in the life sciences field with an eye toward what the patent prosecutor can learn from contested proceedings addressing the written description requirement.  The webinar will focus on the common question of whether the specification discloses sufficient species to offer written description support for a claimed genus and how to best assess that as part of claim drafting to avoid litigation surprises.  They will cover:

II.                What these Federal Circuit decisions tell us about the importance of the written description requirement in litigation


III.              How patent prosecutors can anticipate and mitigate the risk of a written description challenge in future contested proceedings
