Parties often wonder what is required to form the basis for an allegation of willful infringement, including whether and to what extent pre-filing communications are required.  The Federal Circuit has offered some guidance, but district courts take different approaches.  Further, there is an interrelationship between a finding of willfulness and an exceptional case, but not a requirement.  Still further, even upon a finding of an exceptional case, the award of enhanced damages has varied significantly from court to court.  In the end, the landscape has evolved and continues to evolve, requiring patent practitioners and corporations to pivot to meet these changes.
